How it works
Austria has no meaningful standard multi-generational CBD pathway. The primary route is a persecution restitution route (§58c) for descendants of anyone persecuted by the Nazi regime. This pathway has no generational limit, no language test, no residency requirement, and no renunciation of existing citizenship.
Applications are filed as a "declaration" (Anzeige), a simpler process than standard naturalization.
Things to know
- –Austro-Hungarian empire: The 2022 amendment expanded eligibility to descendants of victims who were citizens of any former Austro-Hungarian monarchy state, not just Austria itself. This includes descendants from what is now Hungary, Czech Republic, Slovakia, Slovenia, Croatia, Bosnia, Romania (Transylvania), Ukraine (Galicia), and northern Italy (Trieste, Trentino). This is a massive expansion.
- –Flight before 1955: The original 2020 law required the ancestor to have fled before May 1945. The 2022 amendment extended this to before 1955, significantly broadening eligibility.
- –Declaration process: Unlike standard naturalization, §58c is filed as a declaration at the nearest Austrian diplomatic mission. The applicant does not need to renounce their existing citizenship.
- –Chain integrity NOT required: §58c does not require that Austrian citizenship was continuously transmitted through each generation. If a grandparent naturalized in the US as a result of fleeing, you can still claim as their grandchild. The chain being broken by persecution is exactly what the law is designed to address.
- –Documents: Austria has extensive records in the Austrian State Archives (Österreichisches Staatsarchiv), the Vienna City Archive, and the Documentation Centre of Austrian Resistance (DÖW). Many records are digitized.
