How it works

The Law of Return grants every Jew the right to immigrate to Israel and receive citizenship. The 1970 amendment extended rights to the grandchildren of Jews (and their spouses), even if they are not themselves Jewish under Halakha.

This is not traditional jus sanguinis. It is a right of return with a religious/ethnic eligibility test, not a citizenship chain test.

Things to know

  • –Matrilineal vs. patrilineal: Under Halakha (Jewish law), Jewishness is determined by the mother. However, the Law of Return uses a BROADER definition. Anyone with a Jewish GRANDPARENT (through any line, maternal or paternal) qualifies for the grandchild clause. You can be the grandchild of a Jewish grandfather and qualify under the Law of Return, even if you're not Jewish under Halakha.
  • –Conversion exclusion applies to the APPLICANT, not the ancestor: If a Jewish grandmother converted to Christianity, that does not disqualify her grandchild. But if the applicant themselves converted away from Judaism, they are excluded, even if they were born Jewish.
  • –Spouses: The spouse of any eligible person also qualifies, even if they have no Jewish ancestry at all. This includes divorced spouses (they retain the right) and widowed spouses.
  • –December 2023 SC ruling: The Israeli Supreme Court ruled that Reform/Conservative conversions performed IN Israel must be recognized (a 15-year legal battle resolved). This significantly expanded conversion-based eligibility.
  • –December 2025 SC ruling: A father who converted to Judaism AFTER a child was born does not confer rights on that child under the Law of Return. The conversion must pre-date the child.
  • –Aliyah vs citizenship: The process is called "aliyah" (immigration to Israel). Citizenship is conferred almost immediately upon arrival and declaration of intent to settle. No prior residency required before the aliyah itself.

Getting started

  1. 1.Contact the Jewish Agency for Israel (jewishagency.org), which coordinates aliyah
  2. 2.Gather documents proving Jewish ancestry (synagogue records, Holocaust-era documents, Israeli family records, birth certificates showing Jewish identity)
  3. 3.For conversion-based claims: gather conversion certificate from the synagogue/beit din
  4. 4.Aliyah can be processed from any country via the Jewish Agency and Israeli consulate
